
New York, NY – March 1, 2019 – Today, Senator Gaughran and the State Legislature passed a bill, S.1719C, to outlaw “revenge porn.” Revenge porn is the unlawful dissemination of sexual or sexually explicit images without the subject’s consent to embarrass or harm people, commonly on the Internet or across social media or text messaging. This would make revenge porn a misdemeanor punishable by up to one year in jail. New York joins states across the nation in outlawing revenge porn.
Senator Jim Gaughran said “Starting today, the untold number of victims of ‘revenge porn’ will finally receive justice. Social media and the internet are powerful tools, but they should never aid in exploiting people. I’m proud that my colleague Senator Martinez is leading the charge to outlaw revenge porn in New York.”
This bill would make the unlawful distribution of revenge porn a misdemeanor punishable by up to one year in jail. Victims have said that unlawful distribution of intimate images aka revenge porn has destroyed relationships and cost them jobs and educational opportunities. The removal of images is difficult and costly, and successful removal often necessitates expensive, drawn-out lawsuits. The governor is expected to sign the bill into law.
