Nassau Detective Finds Westbury Woman Slumped Over in Vehicle with Three-Year-Old Child in Car Seat

(Long Island, NY) The Nassau County Police Department has arrested of a Westbury woman for Driving While Intoxicated with a child in the vehicle on Monday, October 27, 2014 at 4:45 p.m. in Williston Park.
According to police, while driving on Hillside Avenue a Third Squad detective was informed by a passing motorist of a possible intoxicated driver. The detective came upon a 2012 Toyota Camry stopped westbound on Hillside Avenue with the front right wheel up on the curb and the engine running.
Danielle Kalberer, 34 of Westbury is charged with Aggravated Driving Intoxicated with a child under 15, Criminal Possession of a Controlled Substance 7th degree, Endangering the Welfare of a Child, two counts of Driving While Intoxicated, and Aggravated Driving While Intoxicated.
Upon investigation the detective discovered the driver Danielle Kalberer, 34 of Westbury slumped over in the driver’s seat and a three year old female child secured in a car seat in the rear of the vehicle.
Third Precinct Officers responded to assist and placed Kalberer under arrest at which time it was discovered that Kalberer was in possession of a single prescription narcotic pill. The child was released to a family member and no injuries were reported.
Kalberer is charged with Aggravated Driving Intoxicated with a child under 15, (Leandra Law), Criminal Possession of a Controlled Substance 7th degree, Endangering the Welfare of a Child, two counts of Driving While Intoxicated, and Aggravated Driving While Intoxicated. She will be arraigned today, Tuesday, October 28, 2014 at First District Court in Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
