(Long Island, NY) A Virginia man was arrested in a burglary that occurred in Merrick at 9:50pm on Friday night.
Police said they found a Chevy Cruze parked blocking a neighbor’s driveway with the door open, interior lights on and a large safe on the front seat of the car when they responded to a residential burglary alarm located on Clubhouse Road.
Officers heard glass shattering coming from the rear of the house. Upon investigation, the subject ran out from behind some bushes and jumped into Merrick Bay to avoid apprehension.
As the subject was exiting the water he refused to comply with the officers and began to struggle by flailing his arms and kicking his legs to prevent his arrest. During a lawful search, the subject was found to be in possession of a car key that belonged to the Chevy Cruze.
Arrested for this incident was Donald P. Smith, 45, of 411 Teepee Drive Newport News Virginia. He is charged with Burglary 2nd Degree and Resisting Arrest. The defendant was scheduled to be arraigned on Sunday, July 28, 2013 in First District Court 99 Main Street Hempstead.
