Father Charged with DWI While Son in Passenger Seat

(Long Island, NY) Cirilo Francisco-Diaz, a 49 year-old Westbury man pleaded not guilty in court on Sunday after being accused of driving while intoxicated with his 10 year-old son in the passenger seat.
Police stated that they witnessed the inebriated father speeding and swerving in between lanes at 1:05 am while on West Old Country Road. After police noticed how Francisco-Diaz was not in control of his 2007 Honda, they signaled him to pull over.
The police officer who spotted Cirilo’s hazardous driving stated that he was driving at a “high rate of speed”. Police then determined that that Cirilo was in fact under the influence and was endangering not only himself, but his 10 year-old child.
His son has been released to a family friend. Francisco-Diaz was charged with aggravated driving while intoxicated under Leandra’s Law. He has also been charged with driving while intoxicated, aggravated driving while intoxicated, and endangering the well fare of a child. Francisco-Diaz a $5,000 bail has be set and as of now remains in custody.
